Data Processing Related to Orders and Invoicing

Legal background and legal basis of data processing: The legal background of data processing is provided by Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information (Info Act) and Act C of 2000 on Accounting (Accounting Act). The legal basis for data processing is your consent in accordance with Section 5 (1) a) of the Info Act, and — in the event of withdrawal of your consent — the fulfillment of the legal obligation imposed on the Data Controller under Section 6 (5) a) of the Info Act, as defined in the Accounting Act. Purpose of data processing: Issuing invoices in compliance with the relevant legislation and fulfilling the obligation to retain accounting documents. According to Section 169 (1)-(2) of the Accounting Act, companies are required to retain all accounting records that directly or indirectly support bookkeeping. Scope of the data processed: Name / Company name, address, email address, phone number. Duration of data processing: According to Section 169 (2) of the Accounting Act, issued invoices must be retained for 8 years from the date of issue. Please note that if you withdraw your consent to the issuance of the invoice, the Data Controller is still entitled to retain the personal data obtained during the invoicing process for 8 years pursuant to Section 6 (5) a) of the Info Act.

Your Rights in Relation to Data Processing

During the data processing period, you are entitled to:

  • the right to object

During the data processing period, you have the right to request information from the Data Controller about the processing of your personal data. The Data Controller shall provide you with a written and intelligible response within the shortest possible time, but no later than 25 days from the submission of the request. This information shall include the data being processed, the purpose, legal basis and duration of the processing, and—if applicable—who has received or is receiving your data and for what purpose.

You may also request the rectification of your personal data during the data processing period. The Data Controller shall fulfill this request within 15 days at the latest.

You have the right to request the erasure of your personal data, which the Data Controller shall carry out within 15 days. The right to erasure does not apply where the Data Controller is legally obligated to continue storing the data, or where, pursuant to Section 6 (5) of the Info Act, the Data Controller is entitled to continue processing the data (e.g., for invoicing purposes).

You may request the restriction of your personal data if its permanent deletion would harm your legitimate interests. Such restricted data may only be processed as long as the purpose that excluded deletion still exists.

You have the right to object to the processing of your personal data.

  • if the processing or transfer of personal data is necessary solely for the fulfillment of a legal obligation applicable to the Data Controller, or for the enforcement of the legitimate interests of the Data Controller, the data recipient, or a third party—except in the case of mandatory data processing or in the case specified in Section 6 (5) of the Info Act.

  • if the use or transfer of personal data—without your consent—is carried out for the purposes of direct marketing, public opinion polling, or scientific research.

The Data Controller shall examine the objection as soon as possible, but no later than 15 days from the submission of the request, make a decision on its merits, and inform you of the decision in writing.

If the Data Controller does not comply with your request for rectification, restriction, or erasure, it shall inform you in writing—or electronically, with your consent—within 25 days of receiving the request, providing the factual and legal reasons for rejecting the request.

Legal Remedies

If you believe that the Data Controller has violated any statutory provision relating to data processing or has failed to fulfill any of your requests, you may initiate an investigation procedure with the National Authority for Data Protection and Freedom of Information in order to eliminate the presumed unlawful data processing.
